In the United States, driver’s licenses are issued by individual states under their laws. This system created a way to ensure concepts of federalism were upheld in the U.S. and also because some states retain their authority in specific areas of the law.

In 1899, Chicago and New York City were recognized as the first cities to issue driver’s licenses after license applicants passed a test. Massachusetts and Missouri were the first states to issue driver’s licenses, beginning in 1903.

Illinois eventually passed its driver’s license law in 1939 and did not require that drivers pass an examination until 1953. Before the enactment of this legislation, many states did not issue driver’s licenses.

The Illinois Supreme Court originally decided that licensing requirements imposed on private individuals were unconstitutional. Many states followed Illinois’ lead until the Great Depression era. In the years that followed, states began imposing license requirements, likely for revenue purposes.

Today, the Illinois Secretary of State is responsible for administering licenses under its Driver Services Department. The requirements for obtaining a license include:

  • Applicants must complete 50 hours of driving
  • Complete a driver’s education course
  • Show proof of enrollment in school
  • Retain a driver’s permit for nine months before applying for a driver’s license
  • Individuals receiving a moving violation during the 9-month period must restart the waiting period
  • People under 18 must honor the curfew requirements, which maintain no driving between 10:00 p.m. and 6:00 a.m.

This web page will address the Illinois DMV locations across the state.

Reasons to Visit the DMV Offices in Illinois

It is essential to regularly maintain an Illinois license, license plate, and registration, which is vital if involved in an auto accident. In addition to issuing driver’s licenses, the DMV offices in Illinois provide:

  • Road tests
  • Driver’s license renewals
  • Driver’s permits
  • Identification cards
  • Vehicle registration
  • License plates
  • Titles
  • Child passenger safety seat fitting stations
  • Vehicle emissions testing stations
  • Hearings and appointments

The Illinois Vehicle Code

The Illinois Vehicle Code contains specific requirements for obtaining a license, identification card or permit. The act mandates that every person must have a driver’s license to operate motorized vehicles on the roads of Illinois. Recently, the Illinois Code was amended to allow undocumented immigrants to apply for and obtain driver’s licenses in the state.

Also, the act maintains a clear distinction between state regulations for licenses and municipal ordinances. Municipalities and cities may not override state law or require individuals to obtain additional licenses.

Some of the other notable points of the Code include:

  • An employee of the U.S. government or Armed Forces is not obligated to have an Illinois license while on official business.
  • Nonresidents do not need Illinois licenses if they have a license from their state or country.
  • Individuals receive a renewal letter 60 to 90 days before the expiration of a license.
  • People might need to fulfill other testing requirements for a renewal of a license, such as vision screening or a new driving exam (applicable to residents over 75).
  • Every eight years, every driver is required to take a written exam unless they have not violated a traffic law.

Extremely impressed with this law firm. They took control of a bad motorcycle crash that left my uncle seriously injured. Without any guarantee of a financial recovery, they went out and hired accident investigators and engineers to help prove how the accident happened. I am grateful that they worked on a contingency fee basis as there was no way we could have paid for these services on our own.

This lawyer really helped me get compensation for my motorcycle accident case. I know there is no way that I could have gotten anywhere near the amount that Mr. Rosenfeld was able to get to settle my case. Thank you.

– Daniel Kaim

Jonathan did a great job helping my family navigate through a lengthy lawsuit involving my grandmother’s death in a nursing home. Through every step of the case, Jonathan kept my family informed of the progression of the case. Although our case eventually settled at a mediation, I really was impressed at how well prepared Jonathan was to take the case to trial.
