About Clergy Sexual Abuse

Clergy sexual abuse refers to the sexual exploitation of minors or adults by high authority religious figures who take advantage of their position and people’s trust. This abuse can have devastating impacts on victims, including emotional trauma, mental health issues, and long-term psychological damage. If you ever witness or suspect clergy sexual abuse happening in your church, you are required by state law to report it immediately to a diocese and law enforcement agency. You could even be penalized under Missouri state law if you fail to report cases before they escalate.

In Missouri, the typical legal process for clergy abuse cases begins with the sexually abused victim or their representative filing a complaint with the appropriate authorities. Victims can also pursue civil suits filed for damages, which involves gathering evidence, depositions, and potentially a trial to seek compensation for the harm suffered.

We are a team of experts committed to providing appropriate legal aid to victims of clergy sexual abuse. Understanding the sensitivity of these cases, our firm handles everything with care and professionalism. We offer confidential consultations to protect the victim’s privacy and provide support in all matters related to filing lawsuits and court proceedings.

Laws and Regulations in Missouri

Missouri has its laws and regulations related to clergy allegedly sexually abused cases that are based on the following legal framework:

Statute of Limitations: Missouri has no SOL for sexual misconduct involving a minor. However, childhood sexual abuse cases must be filed within 10 years of the victims’ coming of age. The SOL for sexual offenses involving an adult is two years.

Mandatory Reporting Laws: All witnesses, especially clergy members, must immediately report cases under the law or risk getting penalized.

Legislative Changes: As more cases are revealed, the regulations have been amended to give victims more protection and make it easier for them to get the help they need.

Compensation: Due to the severe mental and physical harm these sex abuse cases can have on victims, state law allows them to file for compensation for emotional damages and medical expenses they have to pay to heal from the trauma.

Notable Cases and Outcomes in Missouri {Or Estimated Outcome Ranges}

Our attorneys have reviewed public and private settlement data related to Missouri clergy abuse settlements. Depending on the circumstances of your case, these cases may be fairly valued in the $400,000 to $950,000 range. In cases of extreme conduct or if that case were to go before a jury, damages could exceed $1 million.

Report Highlighting Number of Cases: Investigators discovered significant evidence of 163 Catholic church priests and accused clergy members of alleged abuse towards minors in Missouri churches since 1945. These substantiated allegations were documented by the catholic news service across all four of Missouri’s Roman Catholic dioceses: the Jefferson City Diocese, the Kansas City St Joseph Diocese and Kansas City MO Diocese, the Springfield-Cape Girardeau Diocese, and the Archdiocese of St. Louis.

Jefferson City Diocesan Review Board: Based on the report, the Jefferson City diocese’s list was updated with several names in the official Catholic directory ending up on the MO sex offender registry.

Roman Catholic Archdiocese of St Louis: A man alleging sexual abuse charges when he was 10 or 11 years old received a $1 million settlement for it. After these substantiated allegations, he urged lawmakers to remove the time limits for filing as there were cases where the MO supreme court overturned convictions.

Extremely impressed with this law firm. They took control of a bad motorcycle crash that left my uncle seriously injured. Without any guarantee of a financial recovery, they went out and hired accident investigators and engineers to help prove how the accident happened. I am grateful that they worked on a contingency fee basis as there was no way we could have paid for these services on our own.

This lawyer really helped me get compensation for my motorcycle accident case. I know there is no way that I could have gotten anywhere near the amount that Mr. Rosenfeld was able to get to settle my case. Thank you.

– Daniel Kaim

Jonathan did a great job helping my family navigate through a lengthy lawsuit involving my grandmother’s death in a nursing home. Through every step of the case, Jonathan kept my family informed of the progression of the case. Although our case eventually settled at a mediation, I really was impressed at how well prepared Jonathan was to take the case to trial.
