About Clergy Sexual Abuse

Clergy sexual abuse involves religious leaders exploiting their positions to commit sexual offenses against vulnerable individuals, often targeting children and young adults. Victims can suffer deep psychological and physical scars, and many remain silent out of fear. Other clergy members and adults who suspect abuse in their church must report it to law enforcement immediately. Legal action helps hold perpetrators accountable and supports victims’ healing and recovery.

In New Mexico, the legal process begins with a formal complaint, followed by an investigation. If evidence supports the claim, charges are filed, and the case may go to trial. Victims can seek civil remedies for damages.

Rosenfeld Injury Lawyers provide dedicated legal support for clergy sexual abuse survivors in Santa Fe. Our experienced team offers compassionate representation, focusing on justice and compensation. With a proven track record in handling sensitive cases, we guide survivors through the legal process, ensuring their voices are heard and their rights protected.

Laws and Regulations in New Mexico

Statute of Limitations: In New Mexico, the statute of limitations for clergy sexual abuse allows victims to file a civil lawsuit until they turn 24 years old or within three years from the date they discover the abuse or reasonably should have discovered it. Criminal charges for sexual abuse can be filed at any time for first-degree felonies, while second-degree felony charges must be filed within six years.

Mandatory Reporting Laws: In New Mexico, clergy members must report any suspected child abuse, including sexual abuse, to law enforcement or the New Mexico Children, Youth, and Families Department. Failure to report can result in criminal penalties for the clergy member. However, if the information comes from a confidential confession, it’s protected by the clergy-penitent privilege and doesn’t need to be reported.

Legislative Changes: The Child Protection Act and other reforms have enhanced penalties for offenders and improved support systems for survivors. These reforms demonstrate New Mexico’s commitment to addressing clergy sexual abuse and ensuring justice and accountability.

Compensation: Victims of clergy abuse can file lawsuits to claim monetary compensation for expenses such as medical bills, therapy costs, and other related damages.

“Extremely impressed with this law firm. They took control of a bad motorcycle crash that left my uncle seriously injured. Without any guarantee of a financial recovery, they went out and hired accident investigators and engineers to help prove how the accident happened. I am grateful that they worked on a contingency fee basis as there was no way we could have paid for these services on our own.”
